Weymouth Conservation Commission Issues Enforcement Orders, Flags Brook Point Drainage Failure

WEYMOUTH — March 29, 2022 — Weymouth Conservation Commission issued enforcement orders, wetland determinations, and compliance directives across seven cases at its March 29 meeting. Conservation Administrator Mary Ellen Schlegel told commissioners she would not sign off on a certificate of occupancy for the Brook Point apartment project in Weymouth Landing — an 80-plus-unit building where a developer says tenants are scheduled to move in April 1 — after discovering that a required stormwater infiltration system was built with its outlet at the wrong elevation, rendering it nonfunctional. The commission voted unanimously to issue an enforcement order for 24 Cuncannon Circle, where owner Maibeen Gadji filled approximately 150 linear feet of wetland without knowing a 2000 order of conditions remained open on the title; the order requires replanting with 92 native shrubs and saplings and two years of monitoring. Members also preauthorized staff to issue an emergency certification for a collapsing corrugated culvert carrying the Mill River behind 824 Washington Street — an FX Messina property — should the pipe fail before the April 26 meeting, and directed Schlegel to issue a formal notice of violation against the Weymouth Club for a long-neglected wetland replication area, potentially triggering $50-per-day fines.
